As some of my regular readers know, the Military Commissions Act effectively took away a 700 year old piece of commom law. Namely that if you are to be incarcerated, you have the right to ask why and by whom of a court system. Nearly all law worldwide is based on this very simple concept. Last year, the largest democracy in the world eliminated this most basic concept of law. Some Congressmen and the ACLU have an idea on how to get it back.
